for Sale of Goods and Services

The terms and conditions cover Solway Recycling Ltd and Solway Recycling Direct which is a subsidiary of Solway Recycling.

  1. Delivery
    Delivery from website sales is UK mainland only. Contact the office for delivery charges outside of this area.

    All Solway Recycling orders will normally be manufactured and delivered within 15 working days of receipt of payment. Any delivery time scales quoted are an estimate only. If you need your product urgently please put a note in the comments box or make a request direct to the sale office when ordering and we will endeavour to meet the date agreed with the customer. If there are further delays with an order for any reason we will advise the customer of timescale of the delay and the rearranged delivery date.
  2. Product Type
    Nearly all our orders are bespoke or made to order (MTO), however we sometimes hold stock items which are excess or made for display or exhibition purposes. If your order confirmation/ invoice do not state that your order is a stock item, please take it that your order is bespoke/ MTO. Posts, profiles and rails are made to order therefore are classed as a bespoke item as well.

    It is up to the customer to decide if the product is fit for their purpose/ application before ordering.
  3. Product Availability
    All orders are subject to material availability. We reserve the right to alter a products specification without prior notice; shades of colours might be different due to colour changes between batches of base material.

    We reserve the right to alter a product specification as long as it does not affect the product in a significant way.

    All sizes are approximate and may be altered from time to time.

    Profiles are subject to a 5% tolerance level due to the method of manufacture and the properties of the plastic.
  4. Delivery Charges
    Delivery charges vary with each item. They are dependent on weight, floor space, delivery method and priority chosen by the customer. A delivery charge is built into the total sale price.

    We use a courier service for deliveries. We are able to track and trace all orders in the unlikely event of a delivery being late, lost or damaged in transit.

    If you are not available to accept the order at time of delivery, and the courier company has not had instruction to leave the order, a charge will be made. The charge will vary from order to order. This covers the re-delivery charge made by the courier company to Solway Recycling.
  5. Delivery Terms
    Solway Recycling Limited will be responsible for replacing any components sent in error or damaged in transport if reported on receipt of goods. It will be the customer's responsibility to exchange them and make any damaged parts available for collection.

    Solway Recycling Limited use external, 3rd party delivery companies. The customer should examine all products on receipt of them, in order to ensure all products are in a good condition and undamaged before they are singed for by the customer. Alternatively sign for them as damaged. Goods signed for 'unchecked' are just that, unchecked and the courier company or Solway will accept no liability for damages or shortages after the order has been signed for. Customers have 5 days to raise any damage complaints. Solway Recycling Limited will then endeavour to support a customer's claim and will replace damaged or lost parts if signed for as damaged / parts missing on receipt of goods by the customer. Orders signed for in good condition that are later found to be damaged or lost in transit will not be considered for a claim from our courier companies due to the fact they were received and signed for by the customer as delivered and in good condition.

    As Solway use external companies for our deliveries therefore all delivery dates are estimated and not guaranteed. Once the order leaves the Solway Recycling premises it is outwith our control and the reponsibility of the courier. All correspondance with regards your order should be made directly with our courier.

    Solway Recycling will accept no responsibilty for orders which are late or not delivered at the specified time.

    If there are any special requirements these should be notified to Solway at the time of order. For example, if access is restricted, smaller vehicles are needed or the order is to be left somewhere then Solway must be noified. Standard delivery is a large rigid lorry for our palletised items or a large van for the smaller items. If either of these are not suitable for delivery please let Solway know.
  6. Price and Orders
    Every order has a unique order reference number. This is mainly for Solway Recycling Limited purposes. We can take an order reference number from the customer which can be put on the invoice or pro forma.

    Prices may alter at any time without prior notice. We will do our utmost to make sure prices on our website are up-to-date and accurate at all times. Consequently, we cannot accept liability for errors or omissions, whether due to computer malfunction or human error.

    Solway Recycling Limited reserves the right to decline any order for any reason and give a full refund if payment has been made

    The price you pay will be the actual price when we have accepted your order. If we discover an error has been made we will notify you as soon as possible. You may then either confirm your order at the correct price or cancel it. If cancellation is after a payment has been made a full refund will be made

    Delivery times quoted for all orders only start from reciept of payment, not from order date.

    Please check you order as soon as you recieve it. Solway Recycling Ltd must be notified of any discrepancies or shortages within 48 hours of receipt of your order. Any discrepancies or shortages outwith this timescale will not be accepted.
  7. Payment
    We accept all major Credit and Debit Card. We also accept BACS transfer and a cheque as methods of payment. Cheques should be made payable to Solway Recycling Limited.

    Goods ordered will not be despatched until funds have cleared unless otherwise agreed.

    All products are the property of Solway Recycling until payment in full has been received. Solway Recycling Limited has the right to collect any goods which are not paid in full at any time from any premises without invitation or any notice.
  8. Cancellations, Returns and Refunds

    Under The Consumer Protection (Distance Selling) Regulations 2000 or any act which superseeds this our terms on cancellations, returns and refunds are as follows.

    Nearly all our orders are bespoke or made to order (MTO), however we sometimes hold stock items which are excess or made for display or exhibition purposes. If your order confirmation/ invoice do not state that your order is a stock item, please take it that your order is bespoke/ MTO.

    Stock items can be cancelled 14 working days from day of receipt. If the order has been dispatched return costs must be arranged and paid for by the customer. If the product has been used it is non-returnable for hygiene reasons

    You can cancel any bespoke or MTO up to 48 hours after time of order provided it has not been requested urgently and we have committed to manufacturing the product. If production has started on your order you cannot cancel.

    If you wish to return an order which is bespoke or MTO a deduction of up to 20% will be made prior to any refund. All returns must be paid for by the customer. This can be deducted from any potential refund or can be done at their own cost using their own courier.

    If an order has to be returned for any other reason, It is the customer's responsibility to ensure that the goods are re-packaged and loaded onto the courier for return. If products are returned to us broken or faulty, through no fault of Solway Recycling Limited or the courier, then we reserve the right to charge the customer accordingly.
  9. Terms & Conditions of Website Use
    The material in this website is provided for your general information only. Solway Recycling Limited accepts no responsibility for losses occurred as a result of reliance placed upon any parts of the contents of this website and makes no warranty as to the accuracy of any such information or content. Your use of this website is governed by the conditions below and by progressing beyond the home page you are deemed to accept those conditions.

    Unless otherwise stated, all contents and information on this site including limitation text, graphic and images, is property of Solway Recycling Limited or the property of their respective owners and is protected by UK copyright laws. Unauthorised use is strictly forbidden. In particular, none of this website may be copied or incorporated into any other website, database, publication or other work in any form whatsoever.

    While Solway Recycling Limited does its best to ensure that any other website it has links to contains responsible, authoritative and accurate information, it is not responsible for the content of those sites and any views expressed on other sites are not necessarily those of Solway Recycling Limited. In no event will Solway Recycling Limited be liable to you or any other person for loss or damage (whether direct, indirect, special or other) for any use of this website or of any site linked to it by means of hypertext or otherwise. Although all of our animal housing endeavours to be water tight, some joints may leak under severe weather conditions. If this occurs we recommend a run of silicone by the customer after they have recieved or built the house.

    Solway Recycling Limited reserves the right not to include particular information or to make certain links as it thinks fit.

  12. Law and Jurisdiction
    The companies terms and conditions and the contract between the parties shall be governed by the Laws of Scotland and exclusive jurisdiction of the Scottish Courts.
  13. Free plastic drop off
    Farmers and other producers of waste can drop plastic to Solway Recycling main site as per terms below unless there is some other signed contractual agreement in place to take the materials. We currently accept all TUBS and CHEMICAL CONTAINERS free of charge these materials must be triple rinsed. We will accept bale wrap, silage pit covers, polythene feed bags, baler twine and net wrap call our office for current gate fee. Any plastics delivered with foreign contaminants will be levied a sorting charge equivalent to the sorting and disposal costs of the foreign material.

  14. Services/ Products
    Any company, individual or other party who supplies Solway Recycling with a product or service must take the responsibility of invoicing and making the company aware of any unpaid invoices due within a particular financial year. Otherwise, once our previous financial year has been tied off no monies or payment will be back-dated or due for that period. Our financial year runs from 1st January to 31st December.
